These Terms & Conditions (“Terms”) apply to your use of eriksdelieatery.com, catering.eriksdelieatery.com, and any orders, catering requests, or services provided by Break First Deli LLC, doing business as Erik’s Deli & Eatery (“Erik’s,” “we,” “us,” or “our”). By using our websites, requesting a quote, or placing an order, you agree to these Terms.
1. Our Services
Erik’s Deli & Eatery is a deli and catering business located at 525 W Van Buren St, Chicago, IL 60606. We offer in-store dining and pickup, online ordering, and catering for corporate and private events in the Chicago area.
2. Catering Quotes and Orders
A quote request submitted through our website or by phone is not a confirmed order. Your order is confirmed only once we confirm it with you in writing (for example, by email or text message). Quotes are based on the details you provide, such as event date, headcount, menu, and delivery address, and may change if those details change. Some menu items require minimum order quantities, as noted on our menus.
3. Pricing and Payment
Menu prices, item availability, and minimums may change without notice. Applicable taxes, delivery fees, and any other charges will be shown in your quote, order confirmation, or at checkout. Payment terms for catering orders, including any deposit, are stated in your quote or order confirmation.
4. Changes and Cancellations
If you need to change or cancel an order, contact us as early as possible. Change and cancellation terms for catering orders are provided in your quote or order confirmation. Changes requested close to your event may not be possible, and charges may apply for food already prepared.
5. Delivery and Pickup
We deliver within our service area (generally up to 10 miles from our location). Delivery times are estimates; we will do our best to arrive on time, but we are not responsible for delays caused by traffic, weather, building access, or other circumstances outside our control. Please provide an accurate delivery address, an on-site contact, and any building access instructions.
6. Food Allergies and Dietary Needs
Please tell us about any food allergies or dietary restrictions when you request a quote or place an order. Our kitchen handles common food allergens, and we cannot guarantee that any item is free from allergens or cross-contact.
7. Food Safety
Catered food should be served promptly and stored at safe temperatures. Once an order has been delivered or picked up, we are not responsible for food that is left out, improperly stored, or consumed after a safe serving period.
8. SMS Terms
Program description. When you submit a catering quote request on our website, you agree to receive text messages from Erik’s Deli & Eatery about your request. These messages may include confirmation of your quote request, follow-up questions about your event, your quote, order confirmations, and delivery or pickup updates. We do not send marketing or promotional text messages through this program.
Message frequency. Message frequency varies based on your request.
Costs. Message and data rates may apply. Contact your wireless carrier for details about your plan.
Opting out. You can reply STOP to any message at any time to stop receiving text messages. You will receive one final message confirming that you have been unsubscribed, and no further messages will be sent. To start receiving messages again, reply START or submit a new quote request.
Help. Reply HELP to any message for assistance, or contact us at customer@eriksdelieatery.com or (872) 363-9090.
Not required. You do not need to receive text messages to do business with us. You can request a catering quote by calling (872) 363-9090 instead.
Carrier disclaimer. Wireless carriers are not liable for delayed or undelivered messages.
Privacy. We do not sell or share your SMS opt-in data or personal information with third parties for marketing purposes. We handle your information as described in our Privacy Policy (eriksdelieatery.com/privacy). No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent will not be shared with any third parties.
9. Third-Party Ordering Platforms
Orders placed through third-party services such as Ritual or DoorDash are also subject to those services’ own terms and policies.
10. Website Content
The content on our websites, including text, images, logos, and menus, belongs to Erik’s Deli & Eatery or its licensors. You may view and print it for personal, non-commercial use only. Please do not copy, modify, or redistribute it without our permission.
11. Disclaimer
Our websites and their content are provided “as is.” We try to keep menus, prices, and other information accurate and up to date, but we do not guarantee that all information is complete, current, or error-free.
12. Limitation of Liability
To the fullest extent permitted by law, Erik’s Deli & Eatery will not be liable for any indirect, incidental, or consequential damages arising from your use of our websites or services. Our total liability for any claim related to an order will not exceed the amount you paid for that order.
13. Governing Law
These Terms are governed by the laws of the State of Illinois.
